Personally identifiable information (the “PII“): for non-residents of the European Economic Area, essentially includes, but is not limited to, information which can be used to identify, contact or locate You such as Your name, home and business address, email addresses, contact details and payment details.
Personally identifiable information (the “PII“): for residents of the European Economic Area, means any information relating to an identified or identifiable natural person. For the purpose of this definition, an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person, and includes IP address and advertising ID (IDFA/AAID).
Non-personally identifiable information (the “NPII“): NPII includes, but is not limited to, Your IP address, cookies, third party’s cookies, web pages and ads that have been viewed by you on the Orca Studio Platform, time spent on pages, and browser and device type. For non-residents of the European Economic Area, IP address and advertising IDs (IDFA/AAID) are NPII.
PII and NPII shall hereinafter be jointly referred to as the “Information“.
When You visit our web site located at http://orcastudio.co, http://www.orcastudio.co or any sub-domains thereof or any of our applications (collectively, “Orca Studio Platform“), You can choose to ‘Request Access’ and provide us with certain personally identifiable information about Yourself which may include your name, email address, home or business address, company’s name, telephone number, and debit or credit card information such as the credit card number, card verification value, or billing address. When You provide PII directly to us, this PII is used by the Company solely for the purposes identified at the time you provide the PII.
We do not collect this PII from you unless You elect to provide it to us.
We collect non-identifiable information such as the web pages which have been viewed by you on the Orca Studio Platform and click-throughs. We also collect user lead information which will be stored in our system and are accessible to our customers.
You can choose to remove cookies stored by us from your computer, or to prevent us from storing cookies on your computer in the first place. Orca Studio cookies will appear in your browser as coming from one of the following domains: Orca Studio.co, Orca Studio.mobi, Orca Studio.ad. Most browsers are set to automatically accept cookies. The Company may use Your PII, voluntarily submitted by You for purposes of, including but not limited to, identification, authentication, billing, and contacting You with notifications and/or product emails. Further, PII helps us create a more relevant experience for You with the Company. For example, we may use the Customer login name (PII) and connected browsing history (non-PII) to send better directed marketing emails.
We may use NPII when You interact with the Company services to better our studio product in terms of understanding the usage, such as the time spent viewing an ad, page views, video views, number of ads clicked and other information about your interaction with the ads, to better target ad messaging in our ads, show data in aggregate / segmented form for reporting, analytics for customers, third party services. We may use the information internally for any lawful purpose. Additionally, we may share this information with various third parties, including our publishers and advertiser partners. It is important to note that the PII is only provided to a publisher/advertiser when you affirmatively elect to provide such information to such parties.
In addition, the Company may use the Information provided by You or acquire such Information based on Your activities on the Orca Studio Platform, in order to troubleshoot problems, enforce the Company’s Terms and Conditions and/or other related matters.
Otherwise stated above, we do not pass any user identifiable information to any third party.
Further, the Company will delete Your contact information and financial information from its active databases upon request made by You via email at policy@Orca Studio.co. Such information will be deleted as soon as reasonably possible in accordance with its policies and applicable law. However, the Company shall retain Your Information, which shall not be visible to other users or visitors, to be used in certain circumstances including, but not limited to, resolve disputes, troubleshoot problems, enforce the Company Terms and Conditions and as required by applicable law. Please note that some Information is never completely removed and/or deleted from the Company’s databases due to technical and legal constraints, including stored backup systems and archives. In the light of the above, it is not possible for Your Information to be completely removed and/or deleted from the Company’s databases in response to Your requests.
Orca Studio is hosted by public cloud like Amazon, which is often certified for security. Orca Studio has implemented commonly followed industry standards to protect against the unauthorized access to, retention of, and disclosure of information. Any information that is stored on our server is treated as confidential information. However, despite of best efforts, the security is often limited to the limitations and weakness of the state of the art Internet Technology.
The Orca Studio Platform is not intended for children under the age of 13. Consistent with applicable laws, we will never knowingly collect PII from anyone under the age of 13 without requiring parental consent. Any person who provides their personal information to us through the Orca Studio Platform represents that they are 13 years of age or older.
Notwithstanding the above, the Company in no way guarantees that such Information will not be accessed, disclosed, altered or destroyed by breach of firewalls and secured server software. The Company hereby disclaims any liability related to a security breach or loss of Your Information to the greatest extent permissible by law.

For data subjects residing in the European Economic Area: If You are not satisfied with our response, or believe we are processing Your PII not in accordance with the law, and if You are a data subject covered under the GDPR framework, then You have the right to lodge a complaint with a supervisory authority in the Member State of Your habitual residence, place of work, or place of the alleged infringement.
